A WPC is a document issued by a competent authority to a foreigner who is allowed to work for a limited period of time in Vietnam and is a basis to prove the lawful employment of the employer using foreigner workers. However, there are some exemptions for Vietnam Work Permit.
EXEMPTIONS FOR VIETNAM WORK PERMIT
- Member of shareholders, owner of Limited Company
- Member of Board of Chairman of Joint Stock Company
- Director of Representative Office, Director of International Organizations, Non-governmental Organizations at Vietnam
- Individuals that stay in Vietnam less than 3 months to provides sale services
- Labors be seconded to enterprise that have participated in 11 service sectors specified in the service commitment between Vietnam and the WTO, including: business, communication, construction, distribution and education, environment, finance, health, tourism, entertainment and transport.
- Labors come to Vietnam to provide technical consultancy services or other tasks for research, development, evaluation, assess and management.
- Labors is a teacher of a foreign organization appointed by that organization to teach at international schools under the management of diplomatic missions and international organizations in Vietnam.
- Foreigners Labors who is volunteer
- Labors who possess a master's degree or higher and operate in consulting services, teaching or scientific research at higher education institutions and vocational colleges within 30 days.
- Labors entering Vietnam to implement international agreements to which the central state agencies, local state agencies and central socio-political organizations are signatories.
- Person who is granted a license for information and press activities by the Ministry of Foreign Affairs in Vietnam.
- Students studying at foreign schools and training institutions have internship agreements in agencies, organizations and enterprises in Vietnam.
DOCUMENTS TO APPLY EXEMPTION FOR VIETNAM WORK PERMIT
- The written approval of demand for foreign labor
- In case Employees be seconded to enterprise that have participated in 11 service sectors specified in the service commitment between Vietnam and the WTO, including: business, communication, construction, distribution and education, environment, finance, health, tourism, entertainment and transport, documents require :
- Labor contract
- Documents proving that the foreign Employee has been recruited by the foreign enterprise for at least 12 months before being transfered to work in Vietnam.
NOTE
Documents such as Letter of Appointment; Documents proving eligibility for experts and technical workers; Documents certifying the foreign work experience will be exempt from consular legalization, businesses only need to be translated into Vietnamese and authenticated, submitted with the same file when applying for a examption work permit.
